When insurers wrongly deny coverage or delay in the payment of claims, the Firm represents insureds in their disputes with insurance companies. Pruessner & Colley also advises insureds after a loss occurs on the appropriate steps to maximize available coverage. We work with clients in drafting policy language to avoid future litigation, and in training adjusters with regard to coverage and bad faith.

Pruessner & Colley also assists claimants in determining whether their lawsuits will ultimately be covered by a carrier’s insurance policy. Recent examples of the Firm’s work include the following:

  • Cuddeback, et al, v. Citizens Ins. Co. of America, et. al., No. 609CV00533 (E.D. Tex. 2009) (insurer that initially denied coverage paid over $2 million to settle claims.
  • Republic-Vanguard Ins. Co. v. Jose E. Isaguirre, et. al., Cause No. A-11744-11-05, in the 64th Judicial District of Swisher County, Texas (representation of family trucking business in coverage action regarding serious accident)
  • Firm’s demand letter on behalf of Texas Capital Bank resulted in $1 million payment from banker’s bond
  • Firm’s demand letters on behalf of Broadlane resulted in payment from insurers of nearly $1 million in defense costs that had been owed for nearly a year
